Advanced Criminal Appeals former students, Scout Distefano and Alex Frisbie (DePaul University College of Law, Class of 2020), worked together in the fall of 2019 in the Advanced Criminal Appeals Clinic on a criminal appeal on behalf of a Clinic client. They raised two issues in their appeal: (i) the State's failure to prove their client guilty beyond a reasonable doubt and, (ii) that the prosecutor's closing argument was improper and required a remand for a new trial. It took several years for the case to wind its way through the Court and by the time the case was set for oral argument, Ms. Distefano had just been hired by the Office of the State Appellate Defender and argued the case. On August 9, 2021, the Appellate Court reversed the client's conviction outright for the State's failure to prove the client guilty beyond a reasonable doubt.
